1. scope of application
These terms and conditions apply to all bookings and services of Axtwerfen Hamburg a brand of City Paintball Hamburg CPH GmbH (hereinafter referred to as Axtwerfen Hamburg), Bramfelder Chaussee 84, 22177 Hamburg, for both private and business customers.
2. prices
The prices quoted are final prices including VAT. The amount shown at the time of the binding confirmation of the appointment shall apply. Axtwerfen Hamburg is free to grant further discounts through special promotions on site.
3. bookings
(a.) The data required for a match date is recorded in six steps:

Playing time and number of players
Playing time selection
Optional extras
Contact and address details
Booking overview and confirmation
(b.) Binding appointment confirmation:
Once all booking details have been received, you will be contacted by telephone by a member of staff. Possible changes to the booking data can be indicated here. In addition, you will be informed of the following information, which must also be acknowledged and recognised when confirming these GTC:
No alcohol or intoxicating substances that fall under the BtMG may be consumed before playing.
Each player must present an official document/ID card as proof of age. The age limits are as follows:
Playing alone is possible from the age of 18.
From the age of 12, it is only possible to play with a supervisor. All players under the age of 18 must be accompanied by a guardian at all times. This person must be the legal guardian or have been authorised in writing by a legal guardian. An adult (minimum age 27 years) can only ever be a supervisor for one underage player (1:1 supervision). A supervisor must always take part in the game themselves.
All players must be on site at least 15 minutes before the start of the game for the purpose of instruction and changing. Delays can be deducted from the booking playing time without compensation.
Following the telephone call, the customer will receive a binding, chargeable ‘booking confirmation’ of the game date by e-mail. This contains all the data required for the play date, the GTC and the above-mentioned important information.
(c.) Cancellation and costs
A free cancellation of the appointment is possible up to 72 hours (3 full days) before the start of the game. Cancellation can easily be made via the link contained in the ‘Booking confirmation’ email. Immediately after the cancellation, the customer will receive an email confirmation of the cancellation. The number of players can be corrected/changed free of charge within the cancellation period (up to 72 hours before the start of the game).
In the event of cancellations less than 72 hours (3 full days) or non-appearance on the day of the game on site, the admission price of the booking in question, as well as the price for booked barbecue corners and party lounges, is due and will be charged. The payment deadline is 5 days after the date of the game.
(d.) Outdoor courses:
When booking outdoor courses, it is advisable to bring clothing suitable for the weather. In the event of bad weather, indoor courses can be used if they are free-standing. However, this cannot be guaranteed.
(e.) Force majeure
If force majeure (natural disasters, war, civil war, terrorist attack) makes playing or any other service permanently impossible, Axtwerfen Hamburg's obligation to perform is excluded. Amounts already paid will be refunded by Axtwerfen Hamburg without delay.
(f.) Other
If there are official requirements for the date, such as wearing a face mask in the context of combating a pandemic or similar, these will also be communicated in the ‘booking confirmation’ email.
Axtwerfen Hamburg may also refuse to provide the service if this requires an effort that is grossly disproportionate to the customer's interest in the fulfilment of the purchase contract, taking into account the content of the booking and the requirements of good faith. Amounts already paid will be refunded by Axtwerfen Hamburg without delay.
4. payment
Advance payment is needed. In the event of payment in advance, additional products booked on site must also be paid for on site in cash or with an EC card. Payment on account is not possible.
5. debt collection
All outstanding claims against customers, in particular those relating to No. 3 c), are processed by an external service provider: EURONORD Inkasso GmbH & Co. KG, Lüner Weg 19, 21337 Lüneburg. The principles of the privacy policy, which can be viewed online at any time (www.axt-werfen.hamburg), apply to the transfer of data.
6. liability
(a.) In the event of slight negligence, Axtwerfen Hamburg shall only be liable in the event of a breach of material contractual obligations and limited to the foreseeable damage. This limitation does not apply to injury to life, body and health.
(b.) The personal liability of Axtwerfen Hamburg's legal representatives, vicarious agents and employees for damages caused by slight negligence is excluded.
7. applicable law
The contract concluded between you and Axtwerfen Hamburg is exclusively subject to the law of the Federal Republic of Germany. The mandatory provisions of the country in which you have your habitual residence remain unaffected.
8. place of jurisdiction
The place of jurisdiction is Hamburg, Germany.
9. final provisions
(a.) Should individual provisions of this contract be or become invalid or void in whole or in part, this shall not affect the validity of the remainder of the contract, insofar as a contractual partner is not unreasonably disadvantaged by this.
(b.) Amendments or additions to this contract must be made in writing.
